WineDay, Inc. (“WineDay,” “we,” “us,” or “our”) is committed to respecting your privacy and protecting your personal data. This Privacy Policy (“Policy”) describes how we collect, use, disclose, protect, and retain your information when you use the WineDay platform, website, applications, events, and related services (“Service”). By accessing or using our Service, you agree to this Policy.
If you do not agree with our practices, discontinue use of the Service immediately. This Policy applies to all users, including guests, members, Hosts (defined as any individual or entity—such as an independent contractor, third-party user, organization, or business—using WineDay to host or manage events), and prospective partners.
WineDay may update this Policy periodically. Updated versions are effective upon posting to our website. Continued use of the Service constitutes acceptance of changes.

INFORMATION WE COLLECT
We collect various types of information to provide, personalize, and safeguard the Service:
2.1 Information You Provide Directly
Account & Profile Data: Name, contact details (email, address, phone), date of birth, profile photos, preferences, bios, and account credentials.
Health, Dietary, and Accessibility Information: Allergies, dietary restrictions, medical and access needs provided to facilitate safe and tailored event experiences.
Booking & Payment Data: Event registration, payment card details, purchase history, attendance records, and transaction data. (Payment information may be processed by third-party providers per their policies.)
Communications & Content: Correspondence, support requests, surveys, reviews, and other materials submitted to WineDay or Hosts via the platform.
2.2 Information Collected Automatically
Technical/Device Information: IP address, browser, device type, operating system, session times, location (if enabled), and referring URLs.
Usage Data: Platform activity (pages accessed, features used, clicks, engagement), as well as user interaction history.
Cookies & Tracking Technologies: We use cookies and analytics tools for security, performance, personalization, and understanding usage. See our Cookie Policy for more detail.
2.3 Information Received from Third Parties
Social Logins & Connected Services: If you sign up or connect via a third-party provider (e.g., Google, Facebook), we obtain permitted account/profile data subject to your privacy settings.
Third-Party Integrations: Data related to payments, ticketing, or third-party events, subject to those providers’ privacy practices.
2.4 Information Shared with Hosts
For experiences you book or attend, your name, contact details, and any health, allergy, or access needs will be shared as necessary with the designated Host or venue strictly to coordinate event participation and safety. Hosts are required to use such data solely for event purposes and in compliance with this Policy and applicable law.
HOW WE USE YOUR INFORMATION
WineDay uses your information for the following purposes:
Service Operation: To enable, administer, and optimize platform features, events, communications, and user experiences.
Personalization & AI/Algorithmic Processing: We use artificial intelligence (AI), machine learning, and automated algorithms to recommend experiences, facilitate host/guest matching, screen for safety, and tailor participant engagement. AI may analyze your profile, preferences, and prior activity to deliver customized content and suggestions.
Safety, Health, and Access: To arrange accommodations and communicate participant needs for event safety and accessibility.
Payments & Transactions: To process bookings, manage payments, administer refunds, and maintain account records.
Communications: To send confirmations, service updates, event logistics, transactional notices, and respond to support requests.
Legal Compliance & Security: To comply with applicable laws, conduct fraud monitoring, and fulfill regulatory obligations.
Marketing (with user consent): To send newsletters, offers, and promotions. You may adjust email preferences or opt out of marketing at any time.
Research & Analysis: For business insights and service improvement, including using aggregated or anonymized data.
Automated Decisions and Your Rights:
WineDay does not use AI or automated processing to make decisions with legal or significant effects on you without meaningful human review, unless required by law. You may request a human review or contest any AI-generated outcome by contacting privacy@itswineday.com.
HOW WE SHARE YOUR INFORMATION
WineDay does not sell or rent your personal information to third parties. We share information only as described below:
With Hosts & Venues: Information required for event delivery, including your name, contact, and relevant health/access/accommodation data, is shared with Hosts exclusively for the duration of the event. Hosts must process and retain this information solely for Service coordination and safety.
With Third-Party Providers: We provide necessary information to trusted vendors for payments, analytics, marketing, technical support, and security. All vendors are contractually bound to restrict use of the data to specified services and comply with industry-standard security protocols.
Social Networks / Integrations: Information shared or received from connected third-party services is governed by your settings and each provider’s own privacy policy.
Legal or Regulatory Compliance: We may release information in response to lawful requests, government orders, regulatory requirements, or to protect WineDay, users, and the public.
Business Transfers: Data may be transferred if WineDay undergoes a restructuring event (merger, acquisition, asset sale, etc.), subject to ongoing protection under this Policy.
WineDay is not responsible for privacy practices of Hosts, venues, or independent third-party providers not directly operated by WineDay.
DATA SECURITY AND RETENTION
We use advanced security technology and protocols to protect your information against unauthorized access, disclosure, alteration, or destruction, including encryption, network firewalls, monitoring, and regular security audits.
Retention: Personal information is retained only as long as necessary to provide the Service, comply with legal and audit obligations, enforce policies, and prevent fraud. Booking, transaction, and event records may be retained up to ten (10) years unless deletion is authorized by law or requested by users.
Breach Notification: In the event of any data breach affecting your personal information, WineDay will notify affected individuals as soon as practicable, in compliance with applicable legal requirements.
Profile Maintenance: You are responsible for keeping your profile information up-to-date, including contact details, allergies, medical needs, and accessibility information.
Despite our safeguards, no data transmission or storage system is perfectly secure. By using WineDay, you acknowledge and accept these inherent risks.
HOW WE HANDLE YOUR SOCIAL LOGINS
WineDay may allow you to register or log in to the Service using third-party account credentials (such as Google or Facebook). Where you choose to do so, we will receive certain profile and account information from the provider as authorized by your preferences and the provider’s privacy policy. We use this information solely for account creation, user verification, service personalization, and to streamline your login experience.
You may disconnect Social Logins at any time in your account settings. WineDay does not post to third-party accounts without explicit permission. We are not responsible for third-party privacy practices; review their policy for details on data usage.
HOW LONG WE KEEP YOUR INFORMATION
We retain personal information only as long as necessary to fulfill outlined purposes, comply with legal, regulatory, tax, and audit obligations, prevent fraud, and enforce agreements. Transaction, booking, and event history may be stored for up to ten (10) years per applicable law.
Upon account closure, we may retain certain data for the minimum period required for legal defense, regulatory reporting, and fraud prevention, after which it will be securely deleted or anonymized. You may request deletion of data at any time; we will comply unless barred by law or overriding legitimate interests.
HOW WE KEEP YOUR INFORMATION SAFE
WineDay deploys industry-standard security measures, including encryption, authentication, monitoring, firewalls, periodic audits, and employee training to protect data from unauthorized access, loss, misuse, or disclosure.
Despite these safeguards, no system is perfectly secure. We urge you to protect your account credentials and contact us immediately at privacy@itswineday.com with any concerns or suspicions of unauthorized activity. In the event of a data breach, we will notify affected users promptly per legal requirements.
DO WE COLLECT INFORMATION FROM MINORS?
WineDay does not knowingly collect or solicit personal information from anyone under the age of 21. If we discover a user or event participant is under 21, we will promptly delete associated information and deny further access to the Service. If you believe a minor has provided us personal data, contact privacy@itswineday.com immediately.
10. YOUR PRIVACY RIGHTS
Depending on your jurisdiction (US, EU, UK, CA, VA, CO, CT, UT, and others), you have rights over your personal information, including:
The right to access, correct, or update your data at any time in your account/profile.
The right to deletion (right to be forgotten), subject to legal exceptions.
The right to object to or restrict processing of your personal information.
The right to data portability (receive a copy in a structured format).
The right to object to direct marketing and revoke consent at any time.
The right to inquire about automated decisions or request human review (including AI/algorithm outcomes).
The right to lodge a complaint with your local data protection authority.

11. CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature or setting that you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this time, WineDay does not respond to DNT browser signals or similar mechanisms. If a standard for online tracking is adopted that we must follow in the future, we will update this Policy accordingly.
12. CALIFORNIA PRIVACY RIGHTS (CCPA)
If you are a California resident, you have additional rights under the California Consumer Privacy Act (“CCPA”). These include:
The right to request details about the categories and specific pieces of personal information we have collected, used, disclosed, and sold about you in the preceding 12 months.
The right to request deletion of your personal information, subject to certain exceptions.
The right to opt out of the “sale” of your personal information (WineDay does not sell your personal data).

13. VIRGINIA, COLORADO, CONNECTICUT, UTAH, AND OTHER STATE PRIVACY RIGHTS
Residents of Virginia, Colorado, Connecticut, Utah, and other states may have additional rights under applicable privacy laws, including:
The right to access and obtain a copy of your personal data.
The right to correct inaccuracies.
The right to request deletion of your data.
The right to opt out of certain data processing, such as targeted advertising or profiling.
The right to appeal any denial by us of your privacy rights request.

WineDay is committed to making our Privacy Policy, platform, and privacy-related processes accessible to all individuals, including those with disabilities. 18. INTERNATIONAL USERS
WineDay is headquartered in the United States, but our Service may be accessed globally. By using WineDay, you understand that your information may be processed and stored in the US and other jurisdictions, which may have different data protection laws than your country. We comply with international privacy laws where applicable (including GDPR/UK DPA), and implement safeguards to protect your data across borders.

This Privacy Policy is effective as of November 5, 2025 and supersedes all prior versions.
